Hadith 2893

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيل ، حَدَّثَنَا أَبَانُ ، حَدَّثَنَا قَتَادَةُ ، حَدَّثَنِي أَبُو حَسَّانَ ، عَنْ الْأَسْوَدِ بْنِ يَزِيدَ ، أَنَّ مُعَاذَ بْنَ جَبَلٍ ، وَرَّثَ أُخْتًا وَابْنَةً فَجَعَلَ لِكُلِّ وَاحِدَةٍ مِنْهُمَا النِّصْفَ ، وَهُوَ بِالْيَمَنِ وَنَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَئِذٍ حَيٌّ .
Narrated Al-Aswad bin Yazid: Muadh bin Jabal gave shares of inheritance to a sister and a daughter. He gave each of them half. He was at Yemen while the Prophet ﷺ was alive.

Benefits and Issues:
Sisters, together with daughters, become ‘asabah ma‘a al-ghayr (every female who becomes an ‘asabah due to another female).
In this, only the full sister and paternal sister are included.
This occurs when a daughter or granddaughter is present together.
If there is one daughter and one sister,
then each will receive half.
The daughter will receive half from the inheritance,
and the sister, due to being an ‘asabah, will receive the remaining half.
And if there are two or more daughters,
then after the two-thirds (share for the daughters), the remainder will go to the sister or sisters.
