Hadith 2799

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، حَدَّثَنَا الثَّوْرِيُّ ، عَنْ عَاصِمِ بْنِ كُلَيْبٍ ، عَنْ أَبِيهِ ، قَالَ : كُنَّا مَعَ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يُقَالُ لَهُ مُجَاشِعٌ مِنْ بَنِي سُلَيْمٍ فَعَزَّتِ الْغَنَمُ فَأَمَرَ مُنَادِيًا ، فَنَادَى أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقُولُ : " إِنَّ الْجَذَعَ يُوَفِّي مِمَّا يُوَفِّي مِنْهُ الثَّنِيُّ " ، قَالَ أَبُو دَاوُد : وَهُوَ مُجَاشِعُ بْنُ مَسْعُودٍ .
Narrated Asim bin Kulaib: On the authority of his father: We were with a man from the Companions of the Prophet ﷺ called Mujashi' who belonged to Banu Sulaim. There was a scarcity if goats (in those days). He commanded a man to announce (among the people); so he announced that the Messenger of Allah ﷺ used to say: A lamb may be given as full payent for that for which has full-grown animal is payment. Abu Dawud said: His name is Mujashi' bin Masud.

Benefits and Issues:
According to authentic ahadith, the permissibility of a one-year-old goat (jadh‘) has likely been established for three of the Companions (radi Allahu anhum ajma‘in).
The first is Abu Burdah bin Niyar (radi Allahu anhu), whose statement is coming in the following hadith.
The second is the aforementioned Zayd bin Khalid al-Juhani (radi Allahu anhu), and the third is Uqbah bin Amir (radi Allahu anhu).

Benefits and Issues:


Thaniyyah or musinnah refers to that animal whose milk teeth have fallen out and two new teeth have come in.


Jadha’ refers to that animal whose milk teeth have not yet fallen out.


From the above-mentioned hadith and the narration from Umm Bilal rahimahullah:
“Sacrifice the jadha’ of a sheep, for its sacrifice is permissible.” (Musnad Ahmad: 2/368)
it is understood that, even in normal circumstances, the jadha’ of a sheep can be sacrificed. However, according to the narration of Jabir radi Allahu anhu, which is in Sahih Muslim (1963), it is preferable to sacrifice a musinnah (two-toothed) animal.
As Hafiz Ibn Hajar rahimahullah writes regarding this in Fath al-Bari:
Imam Nawawi rahimahullah has transmitted from the majority of scholars that they have interpreted this hadith as indicating preference (afdhaliyyah). See: (Fath al-Bari: 1/20)
Also, according to the preferred opinion, jadha’ is only permissible in sheep, i.e., ram and lamb; it is not permissible to sacrifice the young of other animals of this age.

Shaykh Zuhayt Shawish writes:
In sheep, goats, and cows, musinnah is that which enters its third year, and in camels, that which enters its sixth year.
Regarding the jadha’ of sheep, the well-known and preferred opinion among the linguists and most scholars is that it refers to (the lamb) that has completed one full year.
Imam Shawkani, Imam Nawawi, Hafiz Ibn Hajar rahimahullah, and other scholars have stated the same. (Hashiyah Da’if Sunan Ibn Majah)
However, this is not definitive; due to the different climates of different countries, there can be variation in this. Therefore, the main consideration is that in goats, cows, oxen, and camels, the animal should be two-toothed, and in rams and lambs, it should be one year old.
