Hadith 2755

حَدَّثَنَا الْوَلِيدُ بْنُ عُتْبَةَ ، قَالَ : حَدَّثَنَا الْوَلِيدُ ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْعَلَاءِ ، أَنَّهُ سَمِعَ أَبَا سَلَّامٍ الْأَسْوَدَ ، قَالَ : سَمِعْتُ عَمْرَو بْنَ عَبَسَةَ ، قَالَ : صَلَّى بِنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى بَعِيرٍ مِنَ الْمَغْنَمِ فَلَمَّا سَلَّمَ أَخَذَ وَبَرَةً مِنْ جَنْبِ الْبَعِيرِ ، ثُمَّ قَالَ : " وَلَا يَحِلُّ لِي مِنْ غَنَائِمِكُمْ مِثْلُ هَذَا إِلَّا الْخُمُسُ وَالْخُمُسُ مَرْدُودٌ فِيكُمْ " .
Narrated Amr ibn Abasah: The Messenger of Allah ﷺ led us in prayer facing a camel which had been taken in booty, and when he had given the salutation, he took a hair from the camel's side and said: I have no right as much as this of your booty, but only to the fifth. and the fifth is returned to you.

Brief Explanation
1؎ : From this hadith it is understood that the imam will not take anything from the spoils of war (ghanima) except for the khums (one-fifth), and even the khums that he takes will not be solely his; rather, he will spend it among the Muslims according to the details that Allah Ta'ala has mentioned in the noble verse «واعلموا أنما غنمتم من شيئ فإن لله خمسه وللرسول ولذي القربى ولليتامى والمساكين».

Benefits and Issues:
The Messenger of Allah (sallallahu alayhi wa sallam) would only take one-fifth (khums) from the spoils of war (ghanimah).
In this way, the leader of the Muslims (imam al-muslimin) should also follow the example of the Noble Prophet (sallallahu alayhi wa sallam) in this matter.
And he should not designate any particular item exclusively for himself,
except if there is a specific benefit (maslahah) in doing so.
