Narrated Abdullah ibn Amr ibn al-As: The Messenger of Allah ﷺ, Abu Bakr and Umar burned the belongings of anyone who had been dishonest about booty and beat him. Abu Dawud said: Ali bin Bahr added on the authority of al-Walid, and I did not hear (a tradition) from him: And they denied him his share. " Abu Dawud said: This tradition has also been transmitted by al-Walid bin Utbah from Abd al-Wahhab bin Najdah; They said: This has been transmitted by al-Walid, from Zuhair bin Muhammad, from Amr bin Shuaib. Abd al-Wahhab bin Najdah al-Huti did not mention the words "He denied him his share" (as narrated by Ali bin Bahr from al-Walid).
Explanation & Benefits
Shaykh Umar Farooq Saeedi
Benefits and Issues:
There is no authentic marfu‘ (attributed to the Prophet sallallahu alayhi wa sallam) hadith established in this chapter.
The statement of Salim bin Abdullah bin ‘Umar is also weak in its chain of narration; therefore, this matter is left to the discretion of the leader of the mujahideen.
He may choose to give a corporal punishment to the one who commits treachery in the spoils of war (ghanimah), or deprive him of his wealth,
or prescribe some other punishment.
However, he should avoid burning the belongings.
Because regarding this, there is no authentic marfu‘ or mawquf (attributed to a Companion) narration.
