Hadith 2708

حَدَّثَنَا سَعِيدُ بْنُ مَنْصُورٍ ، وَعُثْمَانُ بْنُ أَبِي شَيْبَةَ المعنى ، قَالَ أَبُو دَاوُد ، وَأَنَا لِحَدِيثِهِ أَتْقَنُ قَالَ : حَدَّثَنَا أَبُو مُعَاوِيَةَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاق ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ ، عَنْ أَبِي مَرْزُوقٍ مَوْلَى تُجِيبَ ، عَنْ حَنَشٍ الصَّنْعَانِيِّ ، عَنْ رُوَيْفِعِ بْنِ ثَابِتٍ الأَنْصَارِيِّ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : "مَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَبِالْيَوْمِ الْآخِرِ فَلَا يَرْكَبْ دَابَّةً مِنْ فَيْءِ الْمُسْلِمِينَ حَتَّى إِذَا أَعْجَفَهَا رَدَّهَا فِيهِ ، وَمَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَبِالْيَوْمِ الْآخِرِ فَلَا يَلْبَسْ ثَوْبًا مِنْ فَيْءِ الْمُسْلِمِينَ حَتَّى إِذَا أَخْلَقَهُ رَدَّهُ فِيهِ " .
Narrated Ruwayfi ibn Thabit al-Ansari: The Prophet ﷺ said: He who believes in Allah and the Last Day must not ride on packhorse belonging to the booty of the Muslims and put it back when he has emaciated it; and he who believes in Allah and the Last Day must not wear a garment belonging to the booty of the Muslims and put it back when he made it threadbare.

Benefits and Issues:
Allah Ta'ala has commanded to take only according to one's due share in matters where rights have been prescribed.
And in general permissible matters, He has commanded mutual consideration and compassion.
Whereas in looting and snatching, instead of entitlement, force and power are used.
And some receive more while others receive less.
And many are left deprived.
Therefore, this manner of conduct is not permissible.

««إسناد حسن» Narrated by Abu Dawud, Kitab al-Jihad, Chapter: Regarding a man benefiting from something of the spoils, Hadith: 2708, and al-Darimi: 2/230.

Explanation:
This hadith establishes that clothing and mounts obtained from war booty (ghanimah) may be used on the battlefield when needed. However, it is prohibited to benefit from a mount in such a way that it becomes weak and emaciated, or to use clothing to the extent that it becomes worn out and old. Therefore, if one fulfills his need without weakening the mount or wearing out the clothing, then it is permissible.
