Narrated Thawban: The Prophet ﷺ said: If any woman asks her husband for divorce without some strong reason, the odour of Paradise will be forbidden to her.

Benefits and Issues:
If there is no harmony between the spouses and the husband is not willing to divorce his wife, while the woman is not prepared to stay with him but is instead insistent on separation, then she should present her case before the judge (qadi).
In view of the actual circumstances, based on the woman's demand for separation, the judge will tell the woman to return her dower (mahr), and then he will annul the marriage contract between them.
This state of separation is called khul‘ (خلع).
Divorce (talaq) is initiated by the husband, whereas in khul‘ the demand comes from the wife.
And the judge enforces the execution of his annulment decision.
In khul‘, the waiting period (‘iddah) is only one menstrual cycle.
Because this is an annulment (fasakh) of the marriage.

Khul‘ means that a woman gives all or part of her dower (mahr) back to her husband and obtains a divorce from him.
It is not permissible for the husband to demand more than the wealth he has given her, or more than the amount of the dower that was stipulated.

Khul‘ is permissible in the situation where the woman does not wish to remain in the marriage with the man, while the man desires to keep her in a proper manner.
If a man deliberately mistreats his wife so that she is forced to agree to khul‘, then this is oppression by the man against the woman.

It is not permissible for a woman to seek divorce from her husband without a valid reason.

If a woman truly feels that it is difficult for her to continue living with the man, then it is permissible for her to seek khul‘. However, just as a man should try his utmost to avoid divorce, similarly, a woman should also strive, as much as possible, to avoid khul‘ and to maintain the household.
