Hadith 2158

حَدَّثَنَا النُّفَيْلِيُّ ، حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، حَدَّثَنِي يَزِيدُ بْنُ أَبِي حَبِيبٍ ، عَنْ أَبِي مَرْزُوقٍ ، عَنْ حَنَشٍ الصَّنْعَانِيِّ ، عَنْ رُوَيْفِعِ بْنِ ثَابِتٍ الْأَنْصَارِيِّ ، قَالَ : قَامَ فِينَا خَطِيبًا ، قَالَ : " أَمَا إِنِّي لَا أَقُولُ لَكُمْ إِلَّا مَا سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ يَوْمَ حُنَيْنٍ ، قَالَ : لَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَسْقِيَ مَاءَهُ زَرْعَ غَيْرِهِ ، يَعْنِي إِتْيَانَ الْحَبَالَى ، وَلَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَقَعَ عَلَى امْرَأَةٍ مِنَ السَّبْيِ حَتَّى يَسْتَبْرِئَهَا ، وَلَا يَحِلُّ لِامْرِئٍ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الْآخِرِ أَنْ يَبِيعَ مَغْنَمًا حَتَّى يُقْسَمَ " .
Narrated Ruwayfi ibn Thabit al-Ansari: Should I tell you what I heard the Messenger of Allah ﷺ say on the day of Hunayn: It is not lawful for a man who believes in Allah and the last day to water what another has sown with his water (meaning intercourse with women who are pregnant); it is not lawful for a man who believes in Allah and the Last Day to have intercourse with a captive woman till she is free from a menstrual course; and it is not lawful for a man who believes in Allah and the Last Day to sell spoil till it is divided.

Benefits and Issues:
➊ For a believing Muslim, speaking with reference to Allah and the Last Day holds utmost importance and emphasis.

➋ To irrigate another’s crop means to have intercourse with another’s wife. That is, adultery (zina) is forbidden, but if a slave woman (bondwoman) is captured in war, it is not permissible to approach her before istibra’ (waiting period to ensure she is not pregnant). If she is pregnant, it is obligatory to wait until she gives birth.

➌ Selling one’s share of war booty before it is determined and received is a form of deception, as it is unknown whether one will receive little or much, or what its value will be.

1:
That is, if a slave woman is pregnant by someone else and then he purchases her, he should not have intercourse with her until she has given birth.

«أخرجه أبوداود، النكاح، باب في وطء السبايا، حديث:2158، والترمذي، النكاح، حديث:1131، وابن حبان(الإحسان):7 /169، 170، والبزار.»©Explanation:
The meaning of this hadith is that when a woman has already become pregnant from the semen of one man, it is not lawful (halal) for another man to have intercourse (wati) or sexual relations (jima‘) with her.

And its example is like that of a slave woman (bondwoman) whom a man has purchased from someone while she was pregnant, or a slave woman who came into the possession of a man as a captive while she was pregnant. Now, for the buyer or the owner/master of such a slave woman, it is not lawful (halal) to have intercourse (wati) or sexual relations (jima‘) with her until she has delivered her pregnancy.
