Hadith 2038

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ ، أَخْبَرَنَا ابْنُ أَبِي ذِئْبٍ ، عَنْ صَالِحٍ مَوْلَى التَّوْءَمَةِ ، عَنْ مَوْلًى لِسَعْدٍ ، أَنَّ سَعْدًا وَجَدَ عَبِيدًا مِنْ عَبِيدِ الْمَدِينَةِ يَقْطَعُونَ مِنْ شَجَرِ الْمَدِينَةِ ، فَأَخَذَ مَتَاعَهُمْ ، وَقَالَ يَعْنِي لِمَوَالِيهِمْ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْهَى أَنْ يُقْطَعَ مِنْ شَجَرِ الْمَدِينَةِ شَيْءٌ ، وَقَالَ : " مَنْ قَطَعَ مِنْهُ شَيْئًا فَلِمَنْ أَخَذَهُ سَلَبُهُ " .
A client of Saad said “Saad found some slaves from the slaves of Madina cutting the trees of Madina. ” So, he took away their property and said to their patrons “I heard the Messenger of Allah ﷺ prohibiting to cut any tree of Madina”. He said “If anyone cuts any one of them, what is taken from him will belong to the one who seizes him. ”

Vocabulary of the Hadith:
(1)
‘Idhah’: Plural of ‘‘Idhah’, ‘‘Idhah’ and ‘‘Idhah’, a large thorny tree.
(2)
‘La’wa’: Hunger and poverty.
(3)
‘Jahd’: Hardship and difficulty.

Benefits and Issues:

From this hadith and another hadith of similar meaning, it is established that the region of Madinah Tayyibah is also a sanctuary (haram), and is worthy of respect, and every action and undertaking that goes against its greatness and sanctity is prohibited therein. Cutting its trees and hunting its animals is not permissible. This is the position of the three Imams: Imam Malik rahimahullah, Imam Shafi‘i rahimahullah, and Imam Ahmad rahimahullah. However, according to the Hanafi Imams, cutting the trees and hunting the animals is permissible; it is merely contrary to its adornment and beauty.


Madinah Munawwarah has this distinction that whoever patiently and calmly endures the difficulties, hardships, hunger, and severity there, will benefit from its blessings and bounties, and will attain the honor that the Messenger of Allah sallallahu alayhi wa sallam will intercede for him on the Day of Resurrection, that his faults and mistakes be forgiven, and that he be pardoned. His righteous deeds, faith, and his patience and forbearance will bear witness for him, or will bear witness for the righteous and obedient people, and he sallallahu alayhi wa sallam will intercede for the people of disobedience.
