Narrated Aishah, Ummul Muminin: I said: Messenger of Allah, should we not build a house or a building which shades you from the sun? He replied: No, it is a place for the one who reaches there earlier.

1؎: That is, the plain of Mina is reserved (waqf) for the pilgrims; it is not the exclusive property of anyone. If someone arrives there first and settles at a spot, another person cannot displace him from it. Since constructing a structure (building a shelter) would establish one’s possession and exclusive right over a particular place, the Prophet (sallallahu alayhi wa sallam) therefore forbade this.
´Aishah said:` "We said: 'O Messenger of Allah! Shall we build a structure to shade you at Mina? He said: 'No., Mina is a resting place for whoever arrives.'"

Commentary: 1: Because it is not permissible to allocate Mina exclusively for anyone, it is the land designated for acts of worship such as stoning (rami), sacrifice (dhabh), and shaving (halq), etc. If permission were given to build houses there, the entire plain would become filled with buildings, and there would be no space left for worship.
