Hadith 1850

حَدَّثَنَا أَبُو سَلَمَةَ مُوسَى بْنُ إِسْمَاعِيلَ ، حَدَّثَنَا حَمَّادٌ ، عَنْ قَيْسٍ ، عَنْ عَطَاءٍ ، عَنْ ابْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : يَا زَيْدَ بْنَ أَرْقَمَ ، هَلْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُهْدِيَ إِلَيْهِ عَضُوُ صَيْدٍ فَلَمْ يَقْبَلْهُ ؟ وَقَالَ : " إِنَّا حُرُمٌ " ، قَالَ : نَعَمْ .
Ibn Abbas said Zaid bin ‘Arqam do you know that the limb of a game was presented to the Messenger of Allah ﷺ but he did not accept it. He said “We are wearing ihram”. He replied, Yes.

This narration indicates that the animal was not presented alive in your (sallallahu alayhi wa sallam) service, rather a piece of a slaughtered animal was presented. The Hanafis say that you (sallallahu alayhi wa sallam) returned it because he had presented a live game, and slaughtering is not permissible for a person in the state of ihram. However, if that had been the case, you (sallallahu alayhi wa sallam) could have said, "Slaughter it and bring it." This narration refutes the position of the Hanafis. The correct explanation has already passed under Hadith number 2821.
