Hadith 1849

حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ ، حَدَّثَنَا سُلَيْمَانُ بْنُ كَثِيرٍ ، عَنْ حُمَيْدٍ الطَّوِيلِ ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ الْحَارِثِ ، عَنْ أَبِيهِ ، وَكَانَ الْحَارِثُ خَلِيفَةَ عُثْمَانَ عَلَى الطَّائِفِ فَصَنَعَ لِعُثْمَانَ طَعَامًا فِيهِ مِنَ الْحَجَلِ وَالْيَعَاقِيبِ وَلَحْمِ الْوَحْشِ ، قَالَ : فَبَعَثَ إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ، فَجَاءَهُ الرَّسُولُ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهُوَ يَخْبِطُ لِأَبَاعِرَ لَهُ فَجَاءَهُ وَهُوَ يَنْفُضُ الْخَبَطَ عَنْ يَدِهِ ، فَقَالُوا لَهُ : كُلْ ، فَقَالَ : " أَطْعِمُوهُ قَوْمًا حَلَالًا فَإِنَّا حُرُمٌ " ، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ : أَنْشُدُ اللَّهَ مَنْ كَانَ هَا هُنَا مِنْ أَشْجَعَ ، أَتَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَهْدَى إِلَيْهِ رَجُلٌ حِمَارَ وَحْشٍ وَهُوَ مُحْرِمٌ فَأَبَى أَنْ يَأْكُلَهُ ؟ قَالُوا : نَعَمْ.
Abdullah ibn al-Harith reported on the authority of his father al-Harith: (My father) al-Harith was the governor of at-Taif under the caliph Uthman. He prepared food for Uthman which contained birds and the flesh of wild ass. He sent it to Ali (may Allah be pleased with him). When the Messenger came to him he was beating leaves for camels and shaking them off with his hand. He said to him: Eat it. He replied: Give it to the people who are not in sacred state; we are wearing ihram. I adjure the people of Ashja who are present here. Do you know that a man presented a wild ass to the Messenger of Allah ﷺ while he was in ihram? But he refused to eat from it. They said: Yes.

Brief Explanation
1؎: The "titir" is a type of beautiful and melodious mountain bird. It sings beautifully on moonlit nights, which is why it is called the lover of the moon.

2؎: For a person in the state of ihram (muhrim), both hunting land animals and eating their meat are prohibited. Similarly, if a non-muhrim person hunts a land animal specifically for a muhrim, then it is also forbidden for the muhrim to eat it. However, if a lawful (halal) person hunts for himself and no muhrim has assisted in any way, even by gesture or hint, and then he presents some of that hunted animal as a gift to a muhrim, then it is permissible for the muhrim to eat it. This is the summary of all the narrations that have come in this chapter, and in this regard, there is no contradiction among them.

1849. English Commentary:
➊ Among the noble Companions (radi Allahu anhum ajma'in), and especially among the Four Rightly Guided Caliphs, there existed the highest degree of brotherhood and affection in their relationships.
➋ Nothing could prevent Ali (radi Allahu anhu) from stating and conveying the truth—not personal attachment nor the governmental positions of others.
➌ The contentment (qana‘ah) that the Messenger of Allah (sallallahu alayhi wa sallam) taught and instilled in his Companions (radi Allahu anhum ajma'in) remained with them throughout their lives, and they always adhered to it.
➍ Ali (radi Allahu anhu) himself served as his own attendant.
➎ If hunting is done with the intention of hosting those in the state of ihram (muhrimīn), then it is not permissible for them to accept it.
