1801. Commentary: That is, along with the ihram of Hajj, ‘umrah can also be performed, i.e., in the form of qiran or tamattu‘. Whereas before Islam, performing ‘umrah during the days of Hajj was considered a major sin.

Benefit:
Nikah Mut'ah (temporary marriage) was initially declared permissible, then it was declared forbidden, and it will remain forbidden until the Day of Judgment. The entire Muslim Ummah is unanimous on its prohibition. A few references are being taken from the book "Maqalat al-Sunnah" by our respected teacher, Shaykh Ghulam Mustafa Zaheer Ameenpuri rahimahullah:
Imam Abu Ubayd, Qasim bin Salam Bilal rahimahullah (150–224 AH) says:
"فـالـمـسـلـمـون اليـوم مجمعون على هذا القول : إن متعة النساء قد نُسخت بالتحريم ، ثم نسخها الكتاب والسنة ۔ ۔ ۔ ، ولا نعلم أحدا من الصحابة كان يترخص فيها ، إلا ما كان من ابن عباس ، فإنه كان ذلك مـعـروفا من رأيه ، ثم بلغنا أنه رجع عنه"
"Today, the Muslims are unanimous on this statement: that Mut'ah with women was abrogated by prohibition, then it was abrogated by the Book and the Sunnah... We do not know of any Companion who gave concession in it, except for Ibn Abbas radi Allahu anhuma, for it was well-known as his opinion. Then it reached us that (upon knowing the truth) he retracted from this opinion." [الناسخ والمنسوخ ص : 80]
Imam Abu Ubaydullah further says:
"وأما قول أهل العلم اليوم جميعا ، من أهل العراق ، وأهل الـحـجاز ، وأهل الشام ، وأصحاب الاثر ، وأصحاب الرأي ، وغيرهم ، أنه لا رخصة فيها لمضطر ولا لغيره ، وأنها منسوخة حرام ، على ما ذكرنا عن النبي صلی اللہ علیہ وسلم وأصحابه"
"As for the statement of all the scholars today, from the people of Iraq, the people of Hijaz, the people of Sham, as well as the people of hadith, the people of opinion, and others, it is unanimously their fatwa that there is no concession in it, whether for one in necessity or otherwise, and that it is abrogated and forbidden, as we have established from the Prophet sallallahu alayhi wa sallam and his Companions." [الناسخ والمنسوخ ص : 82]
Hafiz Abu Muhammad Husayn bin Mas'ud al-Baghawi rahimahullah (d. 516 AH) says:
"ا´´تفق العلماء على تحريم نكاح المتعة ، وهو كالإجماع بين المسلمین"
"The scholars are unanimous on the prohibition of Nikah Mut'ah. This is a consensus among the Muslims." [شرح السنة : 100/9]
Nikah Mut'ah and the Ahadith of the Messenger sallallahu alayhi wa sallam: Nikah Mut'ah was first prohibited at the time of the Battle of Khaybar, then at the time of the conquest of Makkah it was permitted for three days, then it was forbidden until the Day of Judgment. Observe the hadith regarding its prohibition at the time of the Battle of Khaybar:
Hadith No. 1... Sayyiduna Ali radi Allahu anhu informed Sayyiduna Abdullah bin Abbas radi Allahu anhuma:
"إنّ النبى صلى الله عليه وسلم صلى الله عليه وسلم نهى عن المتعة ، وعن لحوم الحمر الأهلية زمن خيبر"
"At the time of the Battle of Khaybar, the Prophet sallallahu alayhi wa sallam forbade Mut'ah marriage and the meat of domesticated donkeys." [صحيح البخاري : 5115 صحيح مسلم : 30/1407]
According to another narration, the words of Sayyiduna Ali radi Allahu anhu are:
"نهى عن متعة النساء يوم خيبر ، وعن أكل لـحـوم الـحـمـر الإنسية"
"On the day of Khaybar, he sallallahu alayhi wa sallam forbade Mut'ah with women and eating the meat of domesticated donkeys." [صحيح البخاري : 606/ 2 ح : 4216 صحيح مسلم : 452/1 ح : 1407]
A narration in Sahih Muslim (1407/31) is as follows:
"إنه سمع ابن عباس يلين فى متعة النساء ، فقال : مهلا يا ابن عباس ! فإن رسول الله صلى الله عليه وسلم صلى الله عليه وسلم نهى عنها يوم خيبر ، وعن لحوم الحمر الإنسية"
"Sayyiduna Ali radi Allahu anhu heard Ibn Abbas radi Allahu anhuma speaking leniently regarding Mut'ah with women, so he said: 'Hold on, O Ibn Abbas! For indeed the Messenger of Allah sallallahu alayhi wa sallam forbade it on the day of Khaybar, and (also forbade) the meat of domesticated donkeys.'"
In another narration of Sahih Muslim (1407/32), the words are:
"نهي رسول الله صلى الله عليه وسلم عن متعة النساء يوم خيبر ، وعن أكل لحوم الحمر الإنسية"
"The Messenger of Allah sallallahu alayhi wa sallam forbade Mut'ah with women on the day of Khaybar, and eating the meat of domesticated donkeys."
The Hadith of Ali radi Allahu anhu and the Scholars of Hadith: Observe the opinions of the scholars regarding the authenticity of this hadith:
➊ Imam Abu Ja'far Ahmad bin Muhammad Nahhas (d. 338 AH) says:
"ولا اختلاف بين العلماء في صحة الإسـتـاد عـن عـلـي بن أبي طالب ، واستقامة طريقه بروايته عن رسول الله صلى الله عليه وسلم تحريم المتعة"
"There is no difference among the scholars regarding the authenticity of the chain from Ali bin Abi Talib radi Allahu anhu, and the soundness of his narration from the Messenger of Allah sallallahu alayhi wa sallam regarding the prohibition of Mut'ah." [الناسخ والمنسوخ ص : 322]
➋ The well-known hadith scholar and commentator, Hafiz Abu Muhammad Husayn bin Mas'ud al-Baghawi rahimahullah (d. 516 AH) says:
"هـذا حـديـث متفق علی صحته"
"This hadith is unanimously agreed upon as authentic." [شرح السنة : 99/9 ح : 2292]
➌ Hafiz Abu'l-Faraj Abdur Rahman bin Ali Ibn al-Jawzi (508–597 AH) says:
"إنه متفق على صحته"
"Undoubtedly, its authenticity is agreed upon by the scholars." [إعـلام الـعـالـم بعد رسوخه بناسخ الحديث ومنسوخه ص : 343]
➍ Hafiz Abu'l-Fadl Abdur Rahim bin Husayn al-Iraqi rahimahullah (725–806 AH) says:
"وهو متفق عليه"
"Its authenticity is agreed upon." [شرح البقرة والتذكرة : 66/2]
➎ Hafiz Abu'l-Hasan Ali bin Muhammad bin Abd al-Samad al-Sakhawi rahimahullah (558–643 AH) also says:
"وهو متفق علیہ"
"This hadith is agreed upon." [فتح المغيث : 350/3]
➏ The Commander of the Faithful in Hadith, Imam Abu Abdullah Muhammad bin Ismail al-Bukhari rahimahullah (194–256 AH) says:
"وبينه على عن النبي صلی اللہ علیہ وسلم صلی اللہ علیہ وسلم أنه منسوخ"
"Ali radi Allahu anhu clarified from the Prophet sallallahu alayhi wa sallam that Mut'ah has been abrogated." [صحيح البخاري تحت الحديث : 5119]
