Hadith 1794

حَدَّثَنَا مُوسَى أَبُو سَلَمَةَ ، حَدَّثَنَا حَمَّادٌ ، عَنْ قَتَادَةَ ، عَنْ أَبِي شَيْخٍ الْهُنَائِيِّ خَيْوَانَ بْنِ خَلْدَةَ مِمَّنْ قَرَأَ عَلَى أَبِي مُوسَى الْأَشْعَرِيِّ مِنْ أَهْلِ الْبَصْرَةِ ، أَنَّ مُعَاوِيَةَ بنَ أَبي سُفْيَانَ ، قَالَ لِأَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ كَذَا وَكَذَا وَعَنْ رُكُوبِ جُلُودِ النُّمُورِ ؟ قَالُوا : نَعَمْ ، قَالَ : فَتَعْلَمُونَ أَنَّهُ نَهَى أَنْ يُقْرَنَ بَيْنَ الْحَجِّ وَالْعُمْرَةِ ؟ فَقَالُوا : أَمَّا هَذَا ، فَلَا ، فَقَالَ : أَمَا إِنَّهَا مَعَهُنَّ وَلَكِنَّكُمْ نَسِيتُمْ " .
Narrated Muawiyah ibn Abu Sufyan: Muawiyah said to the Companions of the Prophet ﷺ: Do you know that the Messenger of Allah ﷺ prohibited from doing so and so (and he prohibited from) riding on the skins of leopards? They said: Yes. He again said: You know that he prohibited combining hajj and Umrah. They replied: This we do not (know). He said: This was prohibited along with other things, but you forgot.

Brief Explanation
1؎: According to some scholars, qiran is superior, then tamattu', then ifrad; and according to others, ifrad is the most superior, then qiran, then tamattu'. The correct opinion is that tamattu' is the most superior. According to Imam Ibn Qayyim and Allamah Albani, both forms of Hajj other than tamattu' (i.e., ifrad and qiran) are abrogated, because the Messenger of Allah (sallallahu alayhi wa sallam) said: "Had I known beforehand what I have come to know now, I would not have brought the sacrificial animal (hady) with me (so that I too could have converted my Hajj into 'umrah)." Thus, the message for the ummah is that henceforth, no one should bring the sacrificial animal (hady) with them at all.

1794. Commentary: This narration, in terms of its chain of transmission, is questionable. However, even if it is authentic, then there is either a misunderstanding regarding Muawiyah’s combining of Hajj and Umrah, or there has been an analogy drawn from mut‘ah (temporary marriage). He considered both mut‘ah of women and mut‘ah of Hajj to be prohibited, just as he was mistaken regarding the Prophet’s (sallallahu alayhi wa sallam) act of shortening the hair (taqsir), thinking it was mentioned in the Farewell Pilgrimage (Hajjat al-Wada‘), whereas in reality it was an incident from the Prophet’s (sallallahu alayhi wa sallam) Umrah.
