حَدَّثَنَا
مُحَمَّدُ بْنُ كَثِيرٍ ، أَخْبَرَنَا
شُعْبَةُ ، عَنْ
الْحَكَمِ ، عَنْ
ابْنِ أَبِي رَافِعٍ ، عَنْ
أَبِي رَافِعٍ ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ رَجُلًا عَلَى الصَّدَقَةِ مِنْ بَنِي مَخْزُومٍ ، فَقَالَ لِأَبِي رَافِعٍ : " اصْحَبْنِي فَإِنَّكَ تُصِيبُ مِنْهَا " ، قَالَ : حَتَّى آتِيَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَسْأَلَهُ ، فَأَتَاهُ فَسَأَلَهُ ، فَقَالَ : "مَوْلَى الْقَوْمِ مِنْ أَنْفُسِهِمْ وَإِنَّا لَا تَحِلُّ لَنَا الصَّدَقَةُ " .
Anas said: The Messenger of Allah ﷺ came upon a date on the road; he would not take it for fear of being a part of the sadaqah.

1651. Commentary: The essence of wara‘ (scrupulousness) and taqwa (piety) is that one should refrain from acting upon anything until it becomes clear and true. In particular, one must exercise great caution regarding doubtful sustenance.
➋ If a date or some other ordinary item is found lying on the ground, it may be picked up and used. The ruling of luqatah (lost property) does not apply to it, meaning that it is not necessary to announce and publicize it first. However, if it is something valuable, then announcement and publicization are obligatory.
